The gun allegedly used to threaten a man in his own bed was his own and there was no robbery, barristers defending four men sensationally claimed today.

Last minute DNA evidence threw doubt onto claims by Farid Yebbou that he was attacked and robbed at his ground floor flat in Woodley Close, Mitcham, by a gunman and three accomplices, a jury heard.

Repeated delays in the start of the trial of Peter Nunes, Sylvanus Scott, Gary Mowatt and Kevin Rodgers were due to last minute revelations that the victim's DNA was found on the handle of the gun allegedly used to threaten him, the court heard.

Defence for the four men on trial said the weapon belonged to the victim and he had threatened the defendants rather than the other way around.

Mr Yebbou, an Algerian who at times struggled to understand questions put to him, was argumentative throughout proceedings and said he could not remember many details of the incident on October 16 last year.

Barry Gilbert, acting on behalf of Mr Rodgers, said: "It was only when you were told your DNA had been found on the gun you volunteered it had touched you."

He later said: "I suggest this is your gun" which Mr Yebbou denied.

Mr Yebbou also denied recognising the men and said he had not been wearing his glasses at the time.

He said: "All black people look the same to me.

"It's not racist I just would not recognise them again."

Mr Gilbert said: "I am suggesting Mr Rodgers came to your flat to pay back a debt.

"You were talking through the window."

"I have no debt," protested Mr Yebbou.

Mr Gilbert claimed Mr Rodgers was paying Mr Yebbou money, something he had been doing every other Thursday.

He claimed Mr Yebbou got angry when Mr Rodgers broughts friends along and ran out of his flat in Woodley Close with his gun.

"I disagree with that," said Mr Yebbou.

Sarah Iskarous on behalf of Mr Nunes said Mr Yebbou's actions were not those of a man just robbed at gunpoint.

Mr Scott, 39, of Balham Grove, Balham, Mr Rodgers, 41, of White Hart Lane, Tottenham, and Mr Nunes, 38, of Honeybrook Road, Balham, all deny robbery and possession of a firearm.

Mr Mowatt , 40, of Laura Place, Hackney, also denies dangerous driving.

The case at Kingston Crown Court continues.
