A devastated mum has blasted one of Britain's biggest supermarkets after her son shattered his femur when he slipped on a fruit and veg bag.

Chloe Phillips, 29, had taken son Maxwell, three, to Morrisons in Erith when the youngster took a tumble on a plastic bag.

After a trip to A&E, his worried mum discovered he had broken his thigh bone.

Children's entertainer Chloe and partner Nicholas Ritch, 33, have now tried to sue Morrisons for damages, but claim the supermarket is denying all responsibility.

Chloe, of Canada Road, Slade Green, said: "We went to the supermarket for a few bits around 7.15 on a Monday.

"Maxwell was in front of me with his dad, and went to run towards him, but he slipped on a clear plastic bag.

"He slipped, basically did the splits and fell down.

"My partner saw him fall and I turned around to see him on the floor - the position his body was in made me feel sick.

"My stomach just turned, his body was really contorted and it was horrible to see the pain on his face.

"He normally cries and makes a fuss when he falls over but he was really quiet, he was obviously in shock.

"We knew straight away that something wasn't quite right but we didn't know how bad it was, so we carried him to the cafe area.

"We tried to get him to stand up but when he couldn't, we took him straight to A&E."

After the accident on August 15, doctors thought Maxwell had damaged his knee, but soon found his injury was far more serious.

Chloe added: "They initially thought it might have been his knee, but his leg got really swollen and after some x-rays, they found out he had a fractured femur.

"He was in hospital for three weeks with his leg elevated on a pulley.

"He had a cast from under his armpits, down both legs to his ankles, for five weeks because he had to keep his hips completely still.

"He's still got to have physio and there'll be more treatment as time goes on - one of his legs is slightly shorter than the other and he's developed a limp.

"I'm devastated, we're all so traumatised and it's horrendous everything he's been through because of one fall."

Now, Chloe and IT manager Nicholas have tried to make a damages claim against the supermarket giant, but it claims it had complied with health and safety rules.

The supermarket is legally obliged to check the floor of the supermarket every half-hour for debris, and its paperwork states it had at the time of the incident.

Chloe said: "I went to a solicitor to make a claim against Morrisons because the bag shouldn't have been on the floor.

"Morrisons aren't taking liability and I'm still really angry about it.

"Although they are legally doing what they have to do to clear up hazards, I don't think it's enough.

"They sent back a record of staff checking the floor every half-hour, which is all they have to do for health and safety.

"My issue is that those bags are clear and a member of staff may not have seen it anyway.

"Every store uses these bags and I notice them everywhere now."

Chloe is now calling for a total ban on the translucent fruit and veg bags, which she says are a safety hazard.

She added: "They're not denying it, but they're denying it's anything to do with them, and they won't do anything about it - they've been so blase.

"They need to stop using these bags and accept they could have done more.

"My son has sustained an injury which could change the rest of his life.

"If his leg continues to have length disparity, it will affect his back, hips, and walking, and it could cause pain as he grows and as an adult.

"My son was a young healthy child, but if a frail elderly person fell and broke their hip, it could kill them.

"He's lucky really, it could have been so much worse, he could have hit his head and really hurt himself .

"Maxwell has come away quite lightly really despite his awful injury."

A Morrisons spokesman said: "We take the safety of our customers extremely seriously and conducted a full investigation following Maxwell's injury.

"We found that our staff followed the correct cleaning procedure and were not at fault. We wish Maxwell a continued recovery."
