Worcester Park Tamil student fights Sutton Council for tuition fees


A teenage refugee is threatening to sue the council after it rejected his application for student support.

Sri Lankan Para Baskaran, 19, of Inverness Road, Worcester Park, started a sociology course at Roehampton University last year and since then has applied for retrospective financial support, to cover the costs of his studies and living.

Mr Baskaran, who is Tamil, moved to the UK when he was nine, after his family lost their home and was forced to live in refugee camps. His mother died when he was seven in the conflict between Tamils and the Sri Lankan army.

Even though he was allowed to stay in this country by the Home Office, Sutton Council refused Mr Baskaran’s application for financial support because his stepmother was not married to his father when she was granted refugee status in 2001.

He said: “They rejected my application on the basis of ‘discretionary policy’.

"I am entitled to this grant and proof of that is my sister was awarded it by West Sussex Council. I just want to finish my studies so I can work in social policy consulting.”

Mr Baskaran, who was granted indefinite leave to remain in the UK in March this year, was told by the university he cannot return until he pays the outstanding fees.

Paul Burstow, MP for Sutton and Cheam, said: “I am asking both Sussex and Sutton how they came to their respective conclusions and trying to find out how they reached different outcomes for people in the exact same circumstances.

“I hope we can find out ways to resolving this without the need for a judicial review.”

A spokesman for Sutton Council said: “Mr Baskaran’s application was turned down in accordance with Government guidelines.

“The rules are complicated, but as Mr Baskaran does not have refugee status in his own right, he would only qualify as a child of a refugee if his step-mother had been his step-mother on the date she applied for refugee status and we do not believe this was the case.

“To be certain we are being fair to him, we have written to the Department of Business, Innovation and Skills to clarify the rules and check our decision was correct. We will be in touch with him as soon as we have a response.”

According to the UK Council for International Student Affairs, students are entitled to support if they have applied for asylum in the UK and the Home Office has decided they do not qualify for refugee status, but should be allowed to stay in the UK.

As a Worcester Park resident, I ask out of interest, why refugees are valued so much more highly than people who either came here to work and contribute to our locality or indigenous locals who similarly work and contribute. Would those of us paying for asylum here be better off claiming asylum in Sri Lanka? It would certainly seem so.

Fair point Alex .....it seems to be very selfish that we take him in after how many safe countries he crossed to get to the Uk???? then he ends up suing Sutton Council - sickening!

The last I heard the conflict in Sri Lanka was over earlier this year.So why is he not going back to help rebuild his country?I look forward to the next part of the story when Sutton Council back down and we have Mr Burstow hugging a Tamil.

Our daughter has just gone to university and what help do we get? NOTHING but then why would we? we are not high earners, on benefit or a refugee just hard working and tax paying. Help yourself in this country and you get nothing it makes me truly sick.

I read the comments, It's not about what critics think, because all those with different views(not their fault entirely*) do not know the full story, what counts is what is Right.
Whats more is that Many people cannot believe this has happenend, and such things can happen these days.
The strength of Racism isnt necessarily what people say, but it is in-built and inforced on people by the Government for alter motives through the policies and propaganda that they address.
THEREFORE
These can be challenged at court to get them changed. BUT This just won't eliminate racism and other inequalities in government policies completely.
So what can we do so that others don't suffer similar inequalities?
Communism, NOT PRATICAL
Authoritarianism, LESS FREEDOM, are we actually that much more free now?
(There are other possible and plauseable types of government structures).
For the moment this present Democratic capitalist Government seems to be the better...
THIS LOOKS TO BE THE WAY FORWARD FOR THE MOMENT for this particular case-->
"The United Nations' International Convention on the Elimination of All Forms of Racial Discrimination 1969, This Convention particularly addresses racial discrimination in employment and education"
* Lets make this clear as far as I know the Judicial for this case, is for a Mandatory order, and this means that this case is NOT to SUE the council, but it is to get the finance that was APPLIED for.
But L@@k the paper got more views on this story because it had the trigger word SUE, which invited attacks on refugees, and reinforce the sterotypes* of Refugees in the public domain.
ALL what is needed is Equality for everyone on this planet, My planet and Yours.
Equality for the Women in Employment, The Fathers who cannot See their Sons and Daughters(fathers for justice), the Starving Children all over the world, The Animals on the brink of extinction... its endless ... I cannot do it myself, But this is for TRUE, If all that who are willing to say "I WILL" (silently), stands up and say it loud, and from that moment, the secound, everything and anything is possible for the better. A better future for our Children to grow up in.
Before we all relise it, when its TOO LATE.
